TanzaniaHosting Terms of Services

These terms of service consitute a legally binding agreement between TanzaniaHosting.com, a service of Oriental Imports (Tanzania) Limited, and any customers who signs up either online through our website, by mail or in person at our office premises. In case the service is resold to an ultimate buyer, the account owner is legally responsible but must ensure that end user/buyer abides by the relevant terms of this agreement.

If you do not agree with all the terms of services listed below, you may not use any of our services, and in case you are already a customer, you should contact TanzaniaHosting immediately to cancel your account.

Ownership of Account
The person or entity listed in our records as primarily billing contacts is considered the owner of the account.

Account Contact Details
It is the responsibility of the customer to provide accurate account information at sign up, and ensure that accounts details remain accurate throughout the life of the account. This includes the billing address, phone number, email address, company name (if any) and contact person full name.

Period of Validity
The terms of services are valid from the date of activation of the hosting services, till its next due date. In case of service renewal, the same terms shall apply until the next due date.

Respect of the Laws
TanzaniaHosting and its parent company Oriental Imports (Tanzania) Limited, are entities legally registered in the United Republic of Tanzania. As such, we shalll comply with all the laws and policies of Tanzania. Customers who use our services are required to comply to the same laws.
For the provision of its services, TanzaniaHosting uses service providers and vendors who may be located outside Tanzania, including but not limited to, the Netherlands, the United Kingdom and the United States. The use of our services should be done within the terms set by the jurisdictions those parties are located. In terms of violation of a specific term, TanzaniaHosting shall notify the customer and provide sufficient notice for the customer to return to compliance.

Payments, Billing and Renewals
TanzaniaHosting receives payment by bank/wire transfer, cheque and Paypal. Currencies accepted are the Tanzanian Shilling and the United States Dollar. Renewals will be invoiced fourteen (14) days prior to the due date/expiration date of the purchased service. Customers have the responsibility to ensure the renewal payments reach us before the due date, to avoid account suspension or cancellation.

Late Payments
A late payment is defined as a payment that is received 10 days after the due date for shared hosting and email hosting (Personal & Business), 2 days after due date for Google Apps and managed cloud services. TanzaniaHosting reserves itself the right to charge a penalty for late payments.

Refund Policy
Shared hosting plans and email hosting plans (Personal & Business) are covered by a 7-day moneyback guarantee. Should these services not meet their requirements, customers can apply for a full refund of all money paid.
Google Apps and Managed Cloud services are not covered by this refund policy.

Cancellation of Services
Customers who wish to cancel their services, may do so by contacting our billing department. This cancellation should be submitted seven days prior to due date at the latest.
Customers can choose to have their services removed from our servers immediately on cancellation date, or until the end of their prepaid term.

Refusal of Service
TanzaniaHosting has the right to refuse service to anyone at anytime. Any material that, in TanzaniaHosting judgement, is obscene, thretening, illegal, or violates TanzaniaHosting terms of services, may be removed from our servers with or without notice.
Threats, attacks, abuse, slander, libel, or rude behaviours are ground for refusal of services.

Uptime Guarantee
TanzaniaHosting does not have a published uptime guarantee. We hold ourselves however to high standards when it comes to the uptime of our servers, which are proactively monitored and regularly upgraded/secured. Customers can expect an uptime above 99.95% when using our services.
In case of downtime issues on a specific server resulting in a downtime of more than 2 hours in a single month, management may provide timely credits to affected customers.

Support Policy
TanzaniaHosting provides technical support 24 hours a day, 7 days a week. This support is provided through our online ticket system. Customers requesting assistance can open support tickets after logging into their client area from our website, or by sending directly an email to support at tanzaniahosting.com

Backup Policy
TanzaniaHosting published its backup policies for each service at our service pages. In all cases, customers are ultimately responsible of their own backups and should not rely on TanzaniaHosting internal backups only. For shared hosting accounts, full backups can be generated at any time from the control panel. Customers are also advised to use third party backup providers for additional security.

Acceptable Usage Policy
TanzaniaHosting services should be used only for lawful purposes. Transmission, storage, linking to or presentation of any information, data or material in violations with the laws of the United Republic of Tanzania are prohibited. This includes, but is not limited to: copyrighted materials, material that is threatening or obscene, materials protected by trade secrets and other regulations.
Customers agree to indemnify TanzaniaHosting from any claim resulting from the use of its services.
Examples of websites not allowed under any circumstances on our servers include, but are not limited to:
-Child pornography
-Adult websites
-Resource intensive website (high CPU/RAM/bandwidth usage)
-File sharing scripts (including video sharing and photo sharing)
-Websites related to DDoS attacks
-Fraudulent websites
-Websites stealing third parties identities
-Mass storage websites (storage of backups, archives, videos etc.)
-Pharmacy sites
-Phishing websites
-Proxy websites
-Mass mailing scripts
-Warez and related websites

Changes to Terms of Service
TanzaniaHosting reserves itself the right to modify these terms of services from time to time as needed. TanzaniaHosting may not be able to notify each customer whenever a change is done. Customers are advised to review our terms of services from time to time.

Governing Laws and Disputes
In case of disputes, the governing laws are those of the United Republic of Tanzania. Any dispute shall be sellted through mutual negotiation, use of third party negotiator, or ultimately, the courts in Dar es Salaam, Tanzania
